Oil Consumption Settlement
The case revolves around claims that Volkswagen Group of America produced a variety of autos that consume excessive amounts of oil. The lawsuit specifically cites the “2009 model year Audi A4 vehicle, 2010 model year Audi A4 and Audi A5 vehicle, and 2011 model-year Audi A4, Audi A5, and Audi Q5 vehicle that were originally equipped with a factory-installed 2.0 liter TFSI longitudinal engine bearing Audi internal engine code CAEB Engine”. Anyone who owned or leased one of the before named autos may be entitled to a settlement in relation to the Oil Consumption Settlement aka Ali Asghari, et al. v. Volkswagen Group of America.
Questions in the case came up in regards to California law:
“The complaint does not allege that any plaintiff relied on the express warranty in deciding to purchase his or her vehicle. Consequently, the court concludes that plaintiffs have failed to state a claim for breach of express warranty under California law,” Judge Morrow said.
The plaintiffs are represented by Jordan L. Lurie and Cody R. Padgett, Payam Shahian and Chris Swanson of Strategic Legal Practices and Dara Tabesh.
