Plaintiffs brought suit against MW Manufacturers, Inc. alleging that their vinyl-clad window models contained design and/or manufacturing defects that led to premature degrading, wood rot and staining, as well as warping and discoloration. The Settlement Class is made up of anyone who purchased certain MW-manufactured window models between 1/1/1987 and 5/23/14. Both parties have agreed on a settlement amount, and those who fill out an online claim form may be entitled to benefits. Deadline to file a claim form is 5/28/16. Those who do file a claim form cannot be part of any other lawsuit against MW Manufacturers. Those who exclude themselves from the Settlement will not receive benefits.

Those who are eligible to receive benefits must have MW-manufactured windows that suffered qualifying damage. This damage is broken up into two levels: Level 1 damage and level 2 damage. Level 1 damage involves MW-manufactured windows that suffered wood rot in the lower portion of the frame. Level 2 damage involves staining or warping of the window frame. The term “window frame” covers the entire wooden frame of an MW-manufactured window, including the jambs. Benefits that each Class Member will receive will be calculated based on the age of the window in question as well as the type of damage in question.
